• Real-Time Chat: WebSocket-based instant messaging between Customers and Content Creators
• Session Management: Time-limited sessions with configurable durations
• Message Limits: Configurable message caps per session
• Media Uploads: Photo and video sharing with automatic watermarking
• Watermarking: Copyright protection via customizable text overlays on media
• Download Controls: Content Creators can enable/disable Customer download permissions
• Session Timers: Live countdown timers with pause/resume/extend functionality
• Admin Gallery: Content Creator dashboard for viewing session media and statistics

5.2 Service Availability

• We strive to provide 24/7 availability but do not guarantee uninterrupted access
• The Service may be temporarily unavailable due to maintenance, updates, or technical issues
• We are not liable for any damages resulting from service interruptions

6. Adult Content and Community Standards

6.1 Adult Content Warning

• By using the Service, you acknowledge that you may be exposed to adult content
• You voluntarily choose to access such content and accept any risks associated with viewing it
• We are not responsible for any emotional distress, offense, or other harm caused by content on the platform

6.2 Prohibited Content

The following types of content are strictly prohibited:

• Child sexual abuse material (CSAM) or any content involving minors
• Non-consensual pornography ("revenge porn")
• Content depicting rape, sexual assault, or violence

7. User Conduct and Responsibilities

• Scrape, crawl, or data mine the platform
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to accounts, systems, or networks
• Upload or transmit viruses, malware, or malicious code
• Violate any applicable local, state, national, or international law

7.2 Customer Responsibilities

As a Customer, you agree to:

• Pay all applicable fees for sessions promptly
• Respect Content Creators' time and boundaries
• Not record, screenshot, or redistribute Content Creator media without permission
• Comply with download restrictions set by Content Creators
• Understand that sessions have time and message limits
• Not request refunds fraudulently

7.3 Content Creator Responsibilities

As a Content Creator, you agree to:

• Provide quality, legal content to paying Customers
• Respect session time limits and deliver value within the allocated time
• Not engage in misleading advertising or bait-and-switch tactics
• Clearly communicate session terms (duration, pricing, services offered)
• Handle Customer disputes professionally
• Comply with all applicable laws regarding adult content creation and distribution
• Maintain appropriate conduct during sessions

8. Payment Terms

8.1 Pricing and Fees

• Session Pricing: Content Creators set session prices based on duration and message limits
• Currency: All prices are listed in USD (or local currency as applicable)
• Payment Processing: Payments are processed through secure third-party payment processors
• Platform Fees: DDAF Enterprises retains a percentage of session fees as commission (rate disclosed during registration)
• Taxes: You are responsible for any applicable taxes on your transactions

8.2 Payment Methods

• Accepted payment methods are determined by the third party processors.
• We do not process any payment data and have no information regarding payment methods.
• You must contact the payment processor you used for any payment issues or disputes.

8.3 Refund Policy

• No Refunds: All sales are final. Sessions are delivered in real-time and cannot be returned
• Technical Issues: If a session is interrupted due to platform failure (not user internet issues), we may provide additional time at our discretion
• Dispute Resolution: Contact support@dawndesire.com within 48 hours of the session with evidence of technical issues
• Fraudulent Chargebacks: Initiating chargebacks without attempting to resolve issues with us may result in account termination and legal action

8.4 Creator Payouts

• Content Creators are paid according to the payout schedule agreed upon during registration
• Minimum payout thresholds may apply
• We reserve the right to withhold payouts pending investigation of suspected fraud or policy violations

9. Intellectual Property Rights

9.1 Platform Ownership

• The Service, including its design, code, features, and branding, is owned by DDAF Enterprises
• All trademarks, logos, and service marks are the property of DawnDesire.com, DDAF Enterprises or our licensors
• You may not use our intellectual property without prior written permission

9.2 User Content Ownership

• You Retain Ownership: You retain all intellectual property rights to content you upload
• License Grant: By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to:
  • Host, store, and display your content
  • Process your content (e.g., apply watermarks, generate thumbnails)
  • Transmit your content to session participants
• Watermarking: We may apply watermarks to protect your content from unauthorized distribution
• No Resale: We do not sell or license your content to third parties without your consent

If you believe content on our platform infringes your copyright, submit a DMCA notice to:

10. Privacy and Data Collection

• Chat messages and uploaded media are stored for the duration of the session and for a limited time afterward
• Content Creators have access to session media through their admin gallery
• We do not record audio or video streams (future feature consideration)

11. Third-Party Services

11.1 Payment Processors

• We use third-party payment processors (e.g., OnlyFans, LoyalFans, Fansly) to handle transactions
• Your payment information is subject to the processor's privacy policy and terms
• We do not store credit card numbers on our servers

11.2 External Links

• The Service may contain links to third-party websites
• We are not responsible for the content, privacy practices, or terms of third-party sites
• Accessing external links is at your own risk

12. Disclaimers and Limitations of Liability

You agree to indemnify, defend, and hold harmless DDAF Enterprises and DawnDesire.com, their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Any claim that your content infringes on intellectual property or other rights

14. Dispute Resolution

14.1 Informal Resolution

• Before filing a legal claim, you agree to first attempt to resolve the dispute informally by contacting us at support@dawndesire.com
• We will attempt to resolve disputes in good faith within 30 days

14.2 Arbitration Agreement

By using the Service, you agree to resolve disputes through binding arbitration instead of court litigation.

• Arbitration Rules: Any dispute shall be resolved through arbitration administered by American Arbitration Association under its rules
• Location: Arbitration shall take place in Jefferson County, Kentucky
• Class Action Waiver: You agree to arbitrate disputes on an individual basis only, not as a class action
• Exceptions: Either party may bring an action in small claims court if the claim qualifies

14.3 Governing Law

• These Terms are governed by the laws of Jefferson County, Kentucky, United States, without regard to conflict of law principles
• Any legal action must be brought in the courts located in Jefferson County, Kentucky

15. Modifications to Terms
